Terms of Service

These Terms of Service ("Terms") govern your access to and use of NexLead AI's website, applications and AI-powered lead generation service (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility and accounts
You must be at least 16 years old and able to enter into a binding contract to use the Service. You are responsible for safeguarding your credentials and for all activity under your account.
2. The Service
NexLead AI uses artificial intelligence to generate search terms, find publicly available business information, score potential leads and organise them in a dashboard. Lead data is derived from public sources and AI inference; we do not guarantee accuracy, completeness or that any contact will convert.
3. Acceptable use
You agree not to:
- Violate any applicable law, including anti-spam, data protection (e.g. GDPR, CAN-SPAM) and telemarketing laws.
- Use leads for unsolicited bulk messaging that does not comply with applicable consent and opt-out rules.
- Reverse engineer, scrape or resell the Service or its outputs in bulk.
- Upload malicious code or attempt to disrupt the Service.
- Use the Service to harass, discriminate against or harm others.
You are solely responsible for how you contact leads generated through the Service and for complying with all applicable laws.
4. Subscriptions and payment
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes apply to the next billing period.
5. Customer data and content
You retain ownership of the inputs and content you submit ("Customer Data"). You grant us a worldwide, non-exclusive licence to host, process and use Customer Data solely to provide and improve the Service. We may use aggregated, de-identified data for analytics and model improvement.
6. Intellectual property
The Service, including its software, design and branding, is owned by NexLead AI and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-transferable, revocable right to use the Service for your internal business purposes.
7. Third-party services
The Service may integrate with third-party services (e.g. AI providers, CRMs). We are not responsible for third-party services and your use of them is subject to their own terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LEADS WILL BE ACCURATE, CURRENT, COMPLETE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADFLOW AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless NexLead AI from any claims arising out of your use of the Service, your Customer Data or your violation of these Terms or applicable law, including outreach to leads.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Upon termination, your right to use the Service ends and we may delete Customer Data after a reasonable period.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which NexLead AI is established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer law provides otherwise.
